This Privacy Policy describes how Tree Diagram LLC ("Company," "we," "us," or "our") collects, uses, and discloses information in connection with the gpu.st cloud GPU instance service ("Service").

By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

Information You Provide

Account Information. When you create an account, we collect information such as your email address, username, and billing information (including payment card details or other payment method information).

Authentication Credentials. We store the public keys for SSH key authentication and passkey credentials you register with your account. We do not have access to your private keys.

Communications. If you contact us for support or other inquiries, we collect the content of those communications along with any contact information you provide.

Information Collected Automatically

Usage and Log Data. We automatically collect information about your use of the Service, including IP addresses, access times, instance creation and termination events, resource usage metrics, and SSH connection metadata.

Device Information. We may collect information about the devices you use to access the Service, such as browser type, operating system, and device identifiers associated with passkey authentication.

Information We Do Not Collect

We do not use third-party advertising networks or tracking services. We do not sell your personal information. We do not access, monitor, or collect the contents of your compute instances or the data you process using the Service, except as necessary for providing technical support at your request or as required by law.

We do not sell your personal information. We may share your information in the following circumstances:

Service Providers. We may share information with third-party vendors who perform services on our behalf, such as payment processing, hosting, and customer support. These providers are contractually obligated to use your information only as necessary to provide services to us.

Legal Requirements. We may disclose your information if required to do so by law or in response to valid legal process, such as a subpoena, court order, or government request. We may also disclose information when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

Business Transfers. If we are involved in a merger, acquisition, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction.

With Your Consent. We may share your information for other purposes with your consent or at your direction.

We retain your account information for as long as your account is active or as needed to provide you with the Service. We retain log and usage data for a reasonable period to fulfill the purposes described in this Privacy Policy, including for security, fraud prevention, and legal compliance purposes.

After account termination, we may retain certain information as required by law or for legitimate business purposes, such as resolving disputes and enforcing our agreements.

Deletion. You may request deletion of your personal information by contacting us. We will comply with such requests to the extent required by applicable law, subject to certain exceptions such as compliance with legal obligations or the exercise or defense of legal claims.

The Service is not directed to individuals under the age of 13. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child, we will take steps to delete such information promptly.

The Service is operated from the United States. If you access the Service from outside the United States, you acknowledge that your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction.
